### Status Clarification<\/strong>
The Services are limited to an independent commercial assessment of evidence supplied or publicly available information reviewed by the Provider. The Services do not constitute certification, declaration, attestation, approval, endorsement or determination of origin for the purposes of Australian Border Force, Department of Foreign Affairs and Trade, Free Trade Agreements, customs legislation, taxation legislation or any other regulatory framework. The Services are privately provided and are not performed on behalf of any Australian Government agency, regulator or certification authority. The Provider is not authorised to issue certificates of origin, government trade documents, or regulatory approvals unless separately authorised by a competent authority. Nothing in this Agreement implies official standing or accreditation.

The Client acknowledges that the Report is a private commercial assessment only and must not be represented to any person, authority, customer or government body as a certificate of origin, government approval, regulatory determination or authorised trade document.

\u5ba2\u6237\u786e\u8ba4\u672c\u62a5\u544a\u4ec5\u4e3a\u79c1\u4eba\u5546\u4e1a\u8bc4\u4f30\uff0c\u4e0d\u5f97\u5411\u4efb\u4f55\u4e2a\u4eba\u3001\u673a\u6784\u3001\u5ba2\u6237\u6216\u653f\u5e9c\u90e8\u95e8\u5ba3\u79f0\u5176\u4e3a\u539f\u4ea7\u5730\u8bc1\u4e66\u3001\u653f\u5e9c\u6279\u51c6\u6587\u4ef6\u3001\u76d1\u7ba1\u8ba4\u5b9a\u6587\u4ef6\u6216\u6388\u6743\u8d38\u6613\u6587\u4ef6\u3002<\/p>

Except as expressly stated in this Agreement, the Provider does not warrant that the Services are suitable for any particular commercial, regulatory, customs, taxation or marketing purpose.

\u9664\u975e\u672c\u534f\u8bae\u53e6\u6709\u660e\u786e\u7ea6\u5b9a\uff0c\u670d\u52a1\u63d0\u4f9b\u65b9\u4e0d\u5bf9\u672c\u670d\u52a1\u9002\u7528\u4e8e\u4efb\u4f55\u7279\u5b9a\u5546\u4e1a\u3001\u76d1\u7ba1\u3001\u6d77\u5173\u3001\u7a0e\u52a1\u6216\u8425\u9500\u76ee\u7684\u4f5c\u51fa\u4fdd\u8bc1\u3002<\/p>

## 1. PURPOSE & STANDARD OF SERVICE<\/strong>
## \u7b2c\u4e00\u6761 \u670d\u52a1\u76ee\u7684\u4e0e\u670d\u52a1\u6807\u51c6<\/strong>
This Agreement sets out terms for independent third\u2011party assessment of evidence relating to claimed Australian origin of goods, including documentary review, public\u2011record cross\u2011checks, traceability analysis and report preparation.
\u672c\u534f\u8bae\u7ea6\u5b9a\u9488\u5bf9\u5546\u54c1\u6fb3\u5927\u5229\u4e9a\u539f\u4ea7\u5730\u4e3b\u5f20\u76f8\u5173\u8bc1\u636e\u8fdb\u884c\u72ec\u7acb\u7b2c\u4e09\u65b9\u8bc4\u4f30\u7684\u6761\u6b3e\uff0c\u5305\u62ec\u6587\u4ef6\u5ba1\u9605\u3001\u516c\u5f00\u8bb0\u5f55\u4ea4\u53c9\u6838\u9a8c\u3001\u6eaf\u6e90\u5206\u6790\u53ca\u62a5\u544a\u7f16\u5236\u3002<\/p>

The Services provide an independent assessment of available evidence and do not constitute a guarantee, certification, accreditation, or formal determination of origin.
\u672c\u670d\u52a1\u4ec5\u5bf9\u73b0\u6709\u8bc1\u636e\u63d0\u4f9b\u72ec\u7acb\u8bc4\u4f30\u7ed3\u8bba\uff0c\u4e0d\u6784\u6210\u5bf9\u539f\u4ea7\u5730\u7684\u4fdd\u8bc1\u3001\u8ba4\u8bc1\u3001\u8d44\u8d28\u8ba4\u53ef\u6216\u6b63\u5f0f\u8ba4\u5b9a\u3002<\/p>

– **Evidence Supported:** Evidence reviewed consistently aligns with the claimed origin at the time of assessment
– **Partially Supported:** Available evidence tends to support the claim but is incomplete or not fully conclusive
– **Unable to Conclude:** Insufficient or unavailable evidence to form a definitive view
– **Evidence Not Supporting Claim:** Available evidence does not align with the claimed origin
– **Inconsistent Evidence:** Material conflicts exist within the reviewed information

**Professional Judgement:** The Client acknowledges that the Services involve professional judgement and assessment of available evidence. A difference of professional opinion, where the Provider has exercised reasonable care, skill and diligence, does not of itself constitute negligence or breach of this Agreement.

The Provider performs Services with reasonable care, skill and diligence consistent with accepted industry practice.

**Use of AI Tools:** AI\u2011assisted tools may be used for administration, research, organisation or preliminary analysis. The Provider does not rely solely on AI outputs; all final findings are subject to human review and judgement by the Provider. The Provider will not knowingly submit Client Confidential Information to publicly available AI systems that use submitted information for general model training purposes without the Client’s written consent. The Provider will take reasonable steps to ensure that any AI\u2011assisted tools used for Client Information are configured to minimise retention, disclosure and secondary use of Client Information.

– **Independent Contractor Status:** No partnership, agency, employment, joint venture or fiduciary relationship is created. Neither party may bind the other to any third party.

**\u62a5\u544a\u6709\u6548\u6027\uff1a** \u62a5\u544a\u4ec5\u4ee5\u670d\u52a1\u63d0\u4f9b\u65b9\u6700\u521d\u51fa\u5177\u3001\u6807\u6ce8\u552f\u4e00\u7f16\u53f7\u3001\u7248\u672c\u53f7\u53ca\u62a5\u544a\u65e5\u671f\u7684\u6b63\u672c\u5f62\u5f0f\u6709\u6548\u3002\u672a\u7ecf\u4e8b\u5148\u4e66\u9762\u8bb8\u53ef\uff0c\u4efb\u4f55\u4fee\u6539\u3001\u6539\u52a8\u6216\u590d\u5236\u5747\u5c5e\u65e0\u6548\u3002<\/p>

**Nature of Services:** Assessment is limited to reasonably obtainable evidence. Unless agreed in writing, the Provider does not conduct covert investigations, forensic examinations, physical inspections, laboratory testing or enforcement activities.

– **Client Warranties:** The Client warrants authority to provide all documents and materials supplied.

– **Report Classification:** Reports are commercial assessment documents only. They are not certificates, licences, approvals, declarations or guarantees unless expressly stated in writing.
– **\u62a5\u544a\u6027\u8d28\uff1a** \u672c\u62a5\u544a\u4ec5\u4e3a\u5546\u4e1a\u8bc4\u4f30\u6587\u4ef6\uff0c\u9664\u975e\u53e6\u6709\u4e66\u9762\u660e\u786e\u8bf4\u660e\uff0c\u4e0d\u6784\u6210\u8bc1\u4e66\u3001\u8bb8\u53ef\u3001\u6279\u51c6\u3001\u7533\u62a5\u6216\u62c5\u4fdd\u6587\u4ef6\u3002

– **Suspension:** May occur immediately on notice for false\/incomplete information, compliance concerns, non\u2011payment or insolvency. Timelines are extended accordingly; termination may follow 30 days’ suspension.

## 8. LIABILITY & RELATED MATTERS<\/strong>

– **Statutory Preservation:** Nothing in this Agreement excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the *Competition and Consumer Act 2010 (Cth)* or any applicable legislation.
